Terms of Service

These Terms of Service (“Terms”) govern your use of the Checkpoint app, website, and commercial portal (together, the “Service”), operated by an individual based in Ontario, Canada (“Checkpoint”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Checkpoint is a platform for creating, sharing, and running orienteering courses and events. We may add, change, or remove features at any time, and we may set limits on use to keep the Service reliable for everyone.

2. Your account

You must provide accurate information when you register and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account. Accounts are for a single person; do not share them. You must be able to form a binding contract to use the Service.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of any applicable law, including outdoor-access, land-use, and trespass rules;
• upload maps, courses, or other content you do not have the right to use;
• harass, abuse, or post unlawful or infringing content on the feedback board;
• interfere with, disrupt, overload, scrape, or attempt to gain unauthorised access to the Service or its systems; or
• reverse engineer or attempt to extract source code except where the law expressly permits it.

4. Your content and maps

You keep ownership of the content you create or upload — clubs, courses, maps, run data, and feedback posts. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and process that content only as needed to operate and provide the Service to you and the people you share it with.

You are responsible for the content you upload. In particular, you confirm that you hold the necessary rights to any map you upload — orienteering maps are often copyrighted works of the club or mapper that made them. We may remove content that we reasonably believe breaches these Terms or the rights of others.

5. Intellectual property

The Checkpoint name, software, design, and branding are owned by the operator and protected by law. These Terms do not grant you any right to use them except as needed to use the Service.

6. Third-party services

The Service relies on third parties, including Microsoft Azure and, if you use them, Google or Microsoft sign-in. Your use of those services is also subject to their own terms, and we are not responsible for them.

7. Outdoor activity and assumption of risk

Orienteering is a physical, outdoor activity that carries inherent risks. Checkpoint provides tools to plan and record activity; it does not supervise it. You are solely responsible for your own safety and for assessing terrain, weather, fitness, navigation, and land-access permissions before and during any activity. You take part at your own risk. GPS and mapping data may be inaccurate or unavailable and must not be relied on as your only means of navigation or safety.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data (including results and GPS tracks) will be accurate or preserved.

9. Limitation of liability

To the fullest extent permitted by law, Checkpoint and its operator will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or personal injury, arising out of or relating to your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or if we reasonably need to protect the Service or its users. Provisions that by their nature should survive termination will do so.

11. Changes to these Terms

We may update these Terms from time to time. We will update the “last updated” date above and, for significant changes, provide a more prominent notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of Ontario will have jurisdiction over any dispute, subject to any mandatory consumer-protection rights you have where you live.
